TERMS OF USE

• The website, found under the URLs www.fairfaxandfavor.com, is provided by Fairfax and Favor Ltd.
• References to “we”, “us” and “our” shall be deemed to be references to Fairfax and Favor Ltd. References to “you” and “your” shall be deemed to be references to the person placing an order via this website.
• Use of this Web Site is subject to the following Terms and Conditions.
• Online customers should also refer to the Terms of Purchase.
• Fairfax and Favor Ltd may revise these Terms, with the revised Terms taking effect for all users as of the date stated on the posting.
• Users are encouraged to periodically reviews these Terms for any changes.
• The www.fairfaxandfavor.com website is designed for your personal, non-commercial use and you must not use it in any other way without our consent.
• Except as permitted under applicable law, you must not use, copy, broadcast, download, store, transmit, publish, licence or adapt in anyway www.fairfaxandfavor.com or any materials or content in www.fairfaxandfavor.com or the structure, overall style and program code of www.fairfaxandfavor.com without our consent.

PURCHASING TERMS

• Your contract for purchases made through www.fairfaxandfavor.com is with Fairfax and Favor Ltd. and you undertake that all goods ordered by you are for your own private and domestic use only and are not for resale.
• You warrant that all details you provide to www.fairfaxandfavor.com for the purpose of ordering or purchasing goods are true, accurate, current and complete in all respects; and that the credit or debit card you are using is your own and that there are sufficient funds in your account to cover payment of the product(s) ordered.
• After placing an order, you will receive an e-mail from us (sent to the email address that you have provided when placing your order) acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order is considered an offer to purchase a product from us.
• All orders are subject to our acceptance. We will confirm acceptance by sending a Dispatch Confirmation email, which signifies that the product has been dispatched. The contract between us is established upon sending the Dispatch Confirmation email.
• Upon placing an order, payment will be taken from your Selected Payment Method, or if using Klarna, then at the time of dispatch. If we are unable to fulfil the order, we will contact you through email to present the available choices at that specific juncture.
• No contract for the sale of any product will exist between you and Fairfax and Favor Ltd until we accept your order by dispatching the product to you. When this happens, we will confirm the acceptance by sending you an email.
• Prices and availability of goods are subject to change without notice.
• All prices include sales tax where applicable for the UK, and, if otherwise (where there is no VAT charged, or at nil rate), no adjustment is made for a VAT equivalent amount on any shipments to sales in other tax jurisdictions. In the event that a sale is made to another tax jurisdiction, where VAT is not chargeable, nil rate or not applicable then the price reflected will not include a reduction of the VAT, nor will a refund of this amount be given.
• A delivery charge will be added to your order value where appropriate, please refer to the Delivery information page.

Our Liability

• Since a substantial part of www.fairfaxandfavor.com is both free and available to all, it is a condition that your use of www.fairfaxandfavor.com is at your own risk.
• We shall not be liable to you or in breach of this User Agreement for any delay or failure to perform any obligation if the delay or failure is due to a cause beyond our reasonable control including, without limitation, the blocking or restricting of information to and/or from our network.
• Except as expressly provided in this User agreement, we disclaim any further representations, warranties, conditions or other terms, express or implied, by statute, collaterally or otherwise, including but not limited to implied warranties, conditions or other terms of satisfactory quality, fitness for a particular purpose or reasonable care and skill.
• We disclaim all and will not be liable in contract, tort (including, without limitation, negligence) or otherwise arising in connection with this User Agreement or the www.fairfaxandfavor.com for: (i) consequential, indirect or special loss or damage; (ii) any loss of goodwill or reputation; (iii) any economic losses (including loss of revenues, profits, contracts, business or anticipated savings), in each case, even if we have been advised of the possibility of such loss or damage and howsoever incurred. Our maximum liability to you in contract, tort (including, without limitation, negligence) or otherwise arising in connection with this User Agreement or the www.fairfaxandfavor.com shall be limited to £50. Notwithstanding any other provision of this User Agreement, we will be liable to you without limit for any death or personal injury caused by our negligence and to the extent that liability arises under Part 1 or section 41 of the Consumer Protection Act 1987 and for liability arising from statements made fraudulently by us.
• Either of us may terminate this User Agreement at any time. You may not transfer any of your rights or delegate any of your obligations under this User Agreement without our prior written consent. If we fail to enforce any provision of this User Agreement, that failure will not preclude us from enforcing either that provision (or any similar provision) on a later occasion.
• Nothing in this User Agreement shall confer on any third party any benefit or the right to enforce any term of the User Agreement. This User Agreement is governed by English law and any dispute connected with this agreement is subject to the exclusive jurisdiction of the English courts. Nothing in this User Agreement affects your statutory rights as a consumer.

Confirmity of Goods

• We take every care to ensure that the description and specification of our products are correct. However, specifications and descriptions of products on this website are not intended to be binding and are intended only to give a general description of the products.
• Furthermore, while the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used by you.
• If products are faulty or below your expectations, please view our FAQs for guidance.

Data Protection

• You are accountable for providing us with a precise and valid email address along with other contact information, as well as informing us about any modifications to these details.
• We cannot be held accountable for any experiences you might have with other users using the website.

Payment

• We accept online payment in a secure environment by many different payment methods, including debit card, credit card, online payment portals and Klarna. We currently accept Mastercard, Visa, Delta and Maestro and American Express.
• All credit card details are encrypted to safeguard your details and no details are saved on any website which is why the payment is processed immediately when the order is placed.
• All prices quoted on this website shown in Pounds Sterling (£) with options for Euros, Canadian Dollars and US Dollars, are accurate at the time of publication, and where appropriate are inclusive of UK sales tax (VAT) at the current rate where required for those areas to which it is charged.
• For customers where VAT is not charged, other Tax jurisdictions, or outside the EU, the VAT will not be charged or shown. The price paid will be in pounds sterling (£), with the rate paid estimated on the website when selecting to be determined by the payment provider at their current exchange rate.
• Fairfax and Favor Ltd can accept no responsibility for additional charges resulting from exchange rate conversions, payment in Sterling, or the exchange rate offered by the payment provider.
• In cooperation with Klarna Financial Services UK Limited, we offer you the following payment options. Payment is to be made to Klarna.

Authorised Discount Usage

• Discounts are provided on a regular basis in good faith, to obtain the Blue Light Card or Military Discount, authorisation will be provided by Fairfax & Favor in providing the code once requested by the customer with indication of an existing, current and up to date Blue Light Card or Military ID.
• Any unauthorised use of these Discount codes may result in the order being cancelled, and, for repeat offences, cessation of trading or supply of goods with the offending individual and all their known aliases.
• In cases where the name on the Blue Light Card or Military Card does not match the name associated with the email, our Customer Service team retain the right to decline providing the discount code.
• Refer a friend discounts are only available to new customers, which are defined as those who have previously never placed an order with Fairfax & Favor.

Brochure Discount Usage

• Brochure discounts are only available to those receiving a brochure between 1st October 2023 and 1st December 2023.
• Any unauthorised use of these Discount codes may result in the order being cancelled, and, for repeat offences, cessation of trading or supply of goods with the offending individual and all their known aliases.
• Brochure discounts are only available to new customers, which are defined as those who have previously never placed an order with Fairfax & Favor, including those refunded or cancelled.
• The discounts cannot be combined with other discounts, offers or combinations.
• If a discount code is not used, Fairfax & Favor will take it as the intent of the customer that the discount code was not to be applied to the order.
• Refunds or compensation for discounts not used, or not applied, will not be given, and the discount code cannot be used retroactively.
• Discount codes can only be applied once per new customer, and cannot be reused if you request a refund for your order.

Cancellation of an order

• Unfortunately, due to how our system runs we’re unable to cancel or amend an order once it has been placed.
• Should the issue be with the address assigned to the order, you are advised to use the DPD or Royal Mail delivery app to change this once you receive a shipping notification.

Delivery

• For full delivery terms please see our Delivery information page.
• If your order cannot be delivered within the timeframe, we had advertised on the website when the order was placed, we will attempt to inform you of the reason for delay, along with a proposed delivery date.
• Goods will be sent to the delivery address given by you when placing the order. If your delivery address is outside of the UK, then we deliver all items on a DDP (Delivered duties paid) basis for all non UK/ EU zone shipments. VAT will be charged (where applicable) inclusive at the rate due based on the shipping location. Where delivered by DDP, or when an order is placed in a different tax jurisdiction, then no adjustment, change or reduction is made for VAT or VAT equivalent amount, and to places where VAT is not charged.
• Where no UK VAT is chargeable on a transaction we do not refund the VAT equivalent or exclude a like value from the sales price. Orders placed outside of the UK do however benefit from duty and local tax free shipping (DDP) to all available locations.

Returns

• For details on Returns & Exchanges please refer to our Returns and Exchanges page. Free Returns and Exchanges are offered on all orders. When returning a product only the cost of the product will be refunded and not the delivery charge.
• Refunds will not be issued for Gift Wrap or Gift Bags in the event of a refunded item, as these services are non-refundable.
• While we are committed to facilitating exchanges, our system operates in a manner that multiple exchanges may lead to us processing a credit note. This approach aims to prevent confusion for both parties involved.
• It’s your responsibility to retain a postage receipt in case any issues arise during transit. In the absence of a valid proof of postage receipt, our Customer Service team cannot facilitate your request.
• We provide a return period of 180 days and an exchange period of 365 days for all Main Stock physical items, including E-Gift Cards and Physical Gift Cards. Please note that any requests for returns or exchanges received beyond these specified time frames for physical items or E-Gift Cards will not be processed.
• We provide a return period of 30 days for all outlet, seconds & sale item(s). Please note that any requests for a refund or exchange received beyond this specified time frame for these items will not be processed.
• We advise that, to get the best feel for our products, they are only tried on inside. Please note that we cannot accept the return of any item that displays signs of wear, especially if it has been worn outside.
• To be eligible for a refund or exchange, all original packaging must be returned with the item. If you do not return the item with the original packaging, your item will be returned to you, and a refund or exchange will not be processed.
• If you require to return an order and you are overseas, please reach out to our Customer Service team who will create a free DHL label. If you return an order via a different courier, the cost will need to be covered by yourself. It’s your responsibility to retain a postage receipt in case any issues arise during transit. In the absence of a valid proof of postage receipt, our Customer Service team cannot facilitate your request.

Black Friday Sale Returns Period

• Discounted items that are purchased during the Black Friday sale will be eligible for a returns period of 180 days and 365 days for exchanges. Following the end of the sale, items purchased from the outlet will return to a return period of 30 days.

Stores

• The pricing for our products remains consistent across both online and in-store platforms; however, it's important to note that sales are exclusively for online purchases and not available in our physical stores.
• We cannot provide refunds or exchanges for items purchased online in our physical stores. However, refunds or exchanges for items purchased in our physical stores can be processed at our store locations.
• If you schedule an appointment at any of our stores and have specific items in mind, we kindly request a 72hour notice to ensure we can arrange for the necessary stock. Our inventory is extensive, and to provide the best service, we require this time to accommodate your preference effectively.
• Unfortunately, we are unable to help with items that may have a potential issue in our stores. If you suspect that your item might have an underlying problem, we kindly request that you contact our Warranty team for further support.
• Our stores offer birthday appointments as a special service. However, these appointment are intended to be used in good faith and not abused. We reserve the right to refuse or cancel any appointments that we deem to be an abuse of this service. Proof of identification may be required to confirm the validity of the birthday appointment.
• We maintain a zero-tolerance policy for abusive language, harassment, threats, offensive remarks, or disrespectful behaviour towards our Stores team. Should this behaviour encounter we reserve the right to impose a ban from you visiting our stores and refrain your access to our services.
• As part of our adherence to the challenge 25 policy, if you intend to consume alcohol and appear to be under 25 years of age without providing valid photographic ID, we regret that we cannot serve you an alcoholic drink.

Stockists

• The contractual agreement for the purchase of items from Fairfax & Favor lies exclusively between you and the chosen stockist. Fairfax & Favor is not a party to this contract.
• In cases where you encounter issues with purchased items or express dissatisfaction with products bought from a stockist, you are required to communicate directly with the respective stockist. Fairfax & Favor's customer service team does not have the authority to intervene or make decisions regarding items obtained from stockists.
• You are advised to familiarise yourselves with the terms and conditions provided by the chosen stockist. It is your responsibility to thoroughly read and comprehend these terms before making a purchase.
• Fairfax & Favor holds no accountability for any terms, conditions, or outcomes stemming your engagement with the chosen stockist. Any disputes, concerns, or inquiries related to items purchased from a stockist should be directed solely to the stockist in question.
• Upon purchasing an item from a stockist, you acknowledge and accept that Fairfax & Favor is not liable for any aspect of the transaction beyond the design, production, and initial supply of the product to the stockist.
• All Fairfax & Favor products have an 18-month warranty however any guarantees, or claims associated with items purchased from stockists are subject to the policies and procedures established by the respective stockist. Fairfax & Favor does not influence or control these policies.
• You are encouraged to retain documentation of your purchases, including receipts and any correspondence with the stockist, for potential future reference in the event of inquiries or concerns.
• Fairfax & Favor reserves the right to modify these terms and conditions at our discretion. However, any alterations will not affect the existing contractual agreements between you and the stockist.
• By purchasing an item from a stockist, you agree to these terms and conditions and acknowledge that they are legally bound by the contract formed with the stockist.
• These terms and conditions represent the entirety of the agreement between you and Fairfax & Favor concerning the purchase of items from stockists. Any additional terms or promises made by stockists are independent of this agreement.

Complaints

• If you believe that your intellectual property or other rights are being infringed by the www.fairfaxandfavor.com, or if you are dissatisfied with www.fairfaxandfavor.com or any aspect of our service, in the first instance please contact info@fairfaxandfavor.com.
• We maintain a zero-tolerance policy for abusive language, harassment, threats, offensive remarks, or disrespectful behaviour towards our Customer Service team. Should this behaviour encounter we reserve the right refrain your access to our services or ban you.

Warranty

• We offer an 18-month warranty on all of our Mains Products and a 6-month warranty on all Seconds Items, which covers manufacturing defects and faulty workmanship. Please note that our warranty does not cover secondhand items.
• As part of our commitment to sustainability, our approach to handling product issues priorities repair as the initial step whenever feasible. This aligns with our efforts to reduce waste and promote environmental responsibility.
• You reserve the right to request either a refund or replacement within 30 days from the date of purchase should a manufacturing fault occur.
• Between 31-180 days from the purchase date, we reserve the right to repair or replace your item should a manufacturing fault occur.
• Beyond the initial 180-day period, we reserve the right to repair the item in the first instance in line with our sustainability goals.
• We retain the authority to decline providing a refund, replacement, or repair if no manufacturing fault is determined.
• In cases where uncertainty exists regarding the items repairability or the cause of an issue, we reserve the right to request the return of the item to us for assessment. Failure to comply with this request will hinder our ability to proceed with your query.
• In certain cases, for repair services we will engage with a third party called “The Boot Repair Company”. This company has been carefully selected for their expertise in repairing footwear, accessories, and clothing.
• Should your item require a repair service beyond the warranty period, we will recommend “The Boot Repair Company”. It is important to note that their terms and conditions will apply to any services provided. While we can offer this recommendation, it remains your responsibility to thoroughly review and understand “The Boot Repair Company’s” terms and conditions before proceeding with their service. Please be aware that Fairfax and Favor Ltd cannot be held accountable for any terms, conditions, or outcomes resulting from your engagement with “The Boot Repair Company”.
• If you choose an independent Cobbler to repair or modernise your item, this will void the 18month warranty.
• To aid in addressing your query, it is essential to provide us with your order number and relevant images. Failure to supply this information will result in our inability to offer additional assistance.

Promotions

• All promotions and offers given to you by Fairfax and Favor Ltd are valid only for use on our website unless otherwise stated and are subject to stock availability.
• Please note promotions and discounts are not applicable to sale items. Any offers may be withdrawn at any time at the discretion of Fairfax & Favor.
• Where items are added to an order as part of a promotion, the item is discounted to no value, but the amount for this promotional item will be removed from the original qualifying purchase if this is not returned when a refund is requested.
• The value of the promotional item will be details on the email-confirmation and at the time of purchase.
• Any promotional items will, unless stated otherwise, have to be added or requested at the time of purchase or when adding qualifying items to the basket.
• Where the item included as part of the free promotion is labelled as free gift wrapping, this will have to be requested when adding the qualifying items to the basket, or at the time of purchase.
• No alternate can be provided, and the value will not be removed from returned items.
• When the order is placed, no guarantee can be made that any offer to buy a product can be changed to include the free gift wrapping.
• Qualifying items shall be detailed and are subject to stock availability. Please be aware that our Clothing & Apparel, Large Travel Bags and e-Gift Cards are not eligible for gift wrapping at any time and thus do not qualify for free gift wrapping during gift wrapping promotions.
• Not all items can be gift wrapped and those which cannot be gift wrapped will not form part of the promotion.
• If you happen to miss a promotional offer, we regret to inform you that we will not be able to provide compensation by sending the item separately at a later time.

Sales

• Sales shall apply during the stated period, with the start date being announced on fairfaxandfavor.com by way of sign up, notification, email or otherwise.
• Sale dates will be provided as accurately as possible, but Fairfax & Favor reserve the right to adjust the sale period without notice.
• Additional discounts cannot be used on sale items, unless explicitly stated.
• Fairfax & Favor reserve the right to apply additional discounts to their items during a sale.
• If a product is bought outside the sale period, Fairfax & Favor will not honour any difference in the sale price.
• If a purchase of a product included in the sale is made,any subsequent price difference is not eligible to be claimed.

Garment Bag included with Apparel

• A Garment Bag will be included with all qualifying piece of Clothing & Apparel. This only applies to qualifying items and excludes the "Charlotte".
• The Garment bag will be automatically added when an item is added to cart, and cannot be removed, with the price being discounted at the time of sale.
• If an item from an order with the Garment Bag is returned, the Garment Bag must be returned or the RRP (£10) of the Garment Bag will be removed from the refunded amount, subject to exchanges and the remaining monetary amount on the order.
• If an item is returned which will take the total order value on qualifying products below the qualifying terms, then the Garment Bag will be removed from the refunded amount, subject to exchanges and the remaining monetary amount on the order. This does not cover any other Free Gift, bags, items, former promotional pieces, key rings or items of a similar name or colour, and only applies to the Garment Bag mentioned as part of this offer.
• The Garment Bag cannot be substituted for another product, cash or credit, and no compensation, monetary value, item or otherwise shall be provided if the Garment Bag is out of stock at the time of purchase, or in retrospect.
• This offer is only available for purchases placed on the Fairfax & Favor website and in our Fairfax & Favor stores.

Competitions

• Residents of the United Kingdom who are 18 years or older are eligible to participate in the competitions. However, employees of Fairfax and Favor Ltd, their close relatives, and those involved in the organisation or judging of the competitions are not eligible to enter.
• There is no entry fee and no purchase necessary to enter competitions.
• By entering this competition, an entrant is indicating his/her agreement to be bound by these terms and conditions.
• Only one entry will be accepted per person.
• Multiple entries from the same person will be disqualified.
• Closing date for entries will be shown on the post of the competition. After this date no further entries to the competition will be permitted.
• We cannot take responsibility for entries that are not received, regardless of the reason.
• For competitions where a partner is involved it is the entrants responsibility to check the partners terms and conditions as Fairfax & Favor cannot be held responsible for external parties.
• Competition prizes cannot be exchanged for cash alternative.

Club Page and Social Media Competitions

• The Competitions cover all social media, such as, “Dog of the Month”, “Pet of the Month”, “Customer of the Month”, and similar competitions.
• Competitions are available for participation to individuals ages 18 years or older, residing in countries where we offer delivery. However, employees of Fairfax and Favor Ltd, their close relatives, and those involved in the organisation or judging of the competitions are not eligible to enter.
• There is no entry fee and no purchase necessary to enter competitions.
• By entering our competitions, an entrant is indicating his/her agreement to be bound by these terms and conditions.
• Closing date for entries will be shown on the relevant post of the competition. After this date then no further entries to the competition will be permitted.
• We cannot take responsibility for entries that are not received, regardless of the reason.
• For competitions where a partner is involved it is the entrants responsibility to check the partner's terms and conditions as Fairfax & Favor cannot be held responsible for external parties.
• Competition prizes are for the amount stated, or the products in question, and cannot be exchanged for cash alternative.
• From the 1st October 2023, all prizes on "Best Dressed" - as well as all other competitions of a directly similar nature - shall award a Winner's prize, and a Runner's up Prize.
• Monthly repeating competitions shall only award a Winner's prize.
• Competitions shall be judges on likes, to the best, reasonable and apparently knowledge of Fairfax & Favor at the time.
• We accept sharing on relevant Fairfax & Favor pages/groups; however we do not accept sharing on “farming” pages/groups or “exchange for likes” pages/groups, and likewise, do not accept self-promotion, competitions, or "calling" for likes in order to boost a post's entry or total likes.
• If anyone who has entered the competition is seen to share on these types of pages/groups, they will be disqualified, and this decision is at the discretion of the Marketing Team at Fairfax & Favor.
• Fairfax & Favor do not condone the use of bullying, trolling, or 'doxing'. If anyone is found to be partaking in such activities, then they may be disqualified, or banned from groups, the page, or taking part in any competitions. This also applies to online harrassment, commentary or bullying on social media, online or other electronic format. Those partaking, either as participants, or as those awarding likes, are to remain respectful of those entering at all times. This decision is at the discretion of the Marketing Team at Fairfax & Favor.

Free Gift Packaging

• Free Gift wrapping shall be available online at www.fairfaxandfavor.com from the 26th October 2023 until 16th November 2023 and from the 8th December 2023.
• The Free Gift wrap shall be offered on the product page, and at cart level.
• If the Free Gift Wrap is not selected, then Fairfax & Favor shall take it as the intent of the customer not to apply it.
• Free Gift Wrap shall apply to all items over £100, or £50 respectively for orders on or after £50, after discounts have been applied.
• This promotion does not cover Apparel, e-Gift Cards, Large Travel Bags or items that would not normally be able to be gift wrapped.
• The Gift wrapping shall appear as indicated on the product page, but changes are permitted based on material, supplies and resources available.
• Fairfax & Favor reserve the right to remove or end the offer at any time.

12 Days of Advent 2023

• The prizes include 12 individual sets of products from Fairfax & Favor.
• Entrants shall receive one entry on signing up to Fairfax & Favor's mailing list, and one subsequent entry for every sign up using their unique identifying link.
• The maximum number of additional entries that can be recorded per entrant shall be three (3), bringing the maximum number of entries per entrant to four (4).
• For an entry to be recorded, an entrant must share the unique referral code made available after signing up, and those referred must sign up to the Mailing List and Competition in the same session after clicking on the aforementioned unique link.
• Subsequent referrals and sign ups from different accounts will affect the referrals recorded against the original Entrant and may affect additional entries.
• One winner shall be selected for each day to win one of the prizes from 1st December 2022 - 12th December 2023 at 1pm (GTM) on each of the indicated dats. The prize is non transferrable.
